By signing up for any course, I am accepting the terms and conditions of the following liability form.
1. I am participating in aqua yoga classes offered by Christa Fairbrother Yoga LLC.
2. I recognize that I must be in good physical/mental health to participate in the activities. I understand that the activities require physical exertion and I am physically fit and have no medical condition which would prevent my participation in the activities. I understand it is my responsibility to consult with a physician before participating in the activities and follow their advice during the activities. I understand it is my continuing responsibility to inform Christa Fairbrother Yoga of any previous medical conditions prior to participating. I understand Christa Fairbrother Yoga reserves the right to refuse my participation on medical/fitness grounds. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured.
3. In participating I agree to assume full responsibility for any risks, injuries or damages which might incur as a result of participating in activities provided by Christa Fairbrother Yoga LLC.
4. I waive any Claim (includes but not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental distress or death that I or my unborn children may suffer including legal fees and expenses) I may have against Christa Fairbrother Yoga LLC, its owners, instructors or presenters (Released Parties) for any claim that I may sustain during my participation even if due to negligence. I agree to indemnify and hold harmless each Released Party from any loss or liability incurred in defending any Claim made by me or someone on my behalf even if due to negligence. I and my heirs or legal representative agree to forever release/waive and covenant not to sue any Released Party for any Claim whether due to negligence or not.
6. I understand that my email address will be used to communicate with me regarding the course and be added to the mailing list of Christa Fairbrother Yoga LLC. See the accompanying privacy policy for more information.
7. By signing up for any course, I acknowledge that I have carefully read this release and waiver of liability and fully understand its contents. I voluntarily and knowingly agree to the terms and conditions stated herein. I am aware that by accepting this release and waiver of liability, I and my heirs are giving up substantial rights including my right to sue.

You must be at least eighteen years of age to use our website. Use of this website is at your own risk. We host our site on a reputable platform and take reasonable efforts to maintain and host the site. HOW IT'S POSSIBLY SHARED

Your email is shared with my email responder, Convertkit.
If you make payments to me, Stripe or PayPal are my payment processors
If you sign up for a private session with me, Acuity is my booking software
If some crazy legal thing happens + I am required by law to do so (so not yogic)
These softwares all have confidentiality clauses that prevent them from legally sharing any of your information.

It is never sold or loaned to any other entity.



COOKIES

Not as cute as they sound, but cookies are used on all websites to track visitor behavior. That means Google Analytics may count you as a visitor to my website, + my facebook ads pixel may count you as a conversion if you opt in to one of my forms.



IS MY INFO PROTECTED?

As much as I + the interweb possibly can. I only use software that contains SSL security...but I'm obviously unable to say your info is "hack proof" as you watch the news.

Every email from me has an unsubscribe button on the bottom. You can use that at any time and I will never email you again.



Live Sessions are photographed during this course.

I hereby give permission to Christa Fairbrother Yoga LLC to use my name and photographic likeness in all forms and media for advertising, trade, promotion and any other lawful purposes. These materials will become the property of Christa Fairbrother Yoga LLC and I authorize them to edit, alter, copy, exhibit, publish or distribute this photo/video image. In addition, I waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any and all rights to compensation in any form regarding the use of these videos, audio recordings or photographic images.

I understand by signing up for aqua yoga, the event is weather and pool condition dependent.
Christa Fairbrother Yoga LLC fully and unconditionally reserves the right to cancel and/or reschedule an event due to rain, lightning, hurricanes or any other weather event.

NOTE - October is still officially hurricane season.  In the unlikely even that a hurricane happens during this weekend, and the training is rescheduled/canceled, you understand you will receive a full refund for your tuition (minus the cost of the pretraining materials) but not for any other costs associated with travel, etc.

As well as, for unforeseen pool failure or safety issues.
In signing up, I understand Christa Fairbrother will contact me directly to handle rescheduling/refunds based on weather and pool closures.
By signing I understand should I cancel my enrollment before June 1st, 2024 (the early bird registration deadline) I'll receive a full refund minus a $20 processing fee. If I cancel between 6/1 and 10/1, I'll receive a 50% refund. If I cancel after 10/1, there are no refunds but I may enroll in a future training at the reenrollment price.
